I freely and voluntarily enrolled in PERIGON’s exercise classes and/or activities.

1. I have reviewed PERIGON’s exercise classes and/or activities and I have been duly informed and I am now aware that they involve rigorous and strenuous activities.
2. I understand that any physical activity carries with it an inherent risk of injury. I am aware that exercise programs may involve strenuous exertions of various areas of the body placing stress on muscles, bones, and joints. Cardiovascular training may involve sustained physical activity placing stress on the heart, arteries, and blood pressure. Risk of injury may be minor such as soreness, sprains, strains, bruises, or serious such as heart attack, stroke, paralysis, and death. I fully understand these risks and agree to assume all risk of injury or illness associated with exercise whatever the cause or injury.
3. I have sought the advice of my physician prior to enrolling and I have been assured I am fit to undergo such strenuous exercise classes and/or activities and I have assured PERIGON and its staff/employees that I am physically, mentally and emotionally fit to join and undertake the exercise classes and/or activities they offer;
4. I agree that PERIGON assumes no risk or liability for my participation in the activities and that I participate at my sole discretion and risk.
5. I hereby release PERIGON Projects, Inc., its owners, members, officers, employees, and agents from any liability for any emotional or physical or injury or illness I may sustain or incur as a result, in connection with or arising from the use of its facilities, equipment, services, permits, products, instruction, advice and/or premises;
6. I further release, quitclaim and waive any and all claim against PERIGON Projects, Inc., its owners and members for any loss, damage, or injury which I may sustain on account of any act or negligence, including theft or fraud, of any client, guest, or employee of PERIGON.
7. I am executing this document on my own behalf, my spouse or partner, my heirs and anyone else claiming by or through me to release, waive, and forever discharge and hold harmless PERIGON, its directors, members, owners and employees from any and all liability from any and all claims, demands, or lawsuits arising from or in connection with my use of its facilities and premises and my participation in any of its exercise programs.
8. I agree that the execution of this release, quitclaim and waiver is a precondition for my joining any class and/or activity or using the facilities of PERIGON and thus, I undertake to immediately cease and desist from doing so if I revoke or cancel or dispute this release, quitclaim and waiver.
